This brief essay by the great Richard Epstein is policy analysis at its best . Epstein here demolishes the case for mandated paid sick leave.
Of course, many of the arguments that he marshals against mandate paid sick leave apply just as strongly against the case for a mandated minimum wage: restricting employees’ abilities to structure their employment contracts in ways that make those contracts most attractive to themselves and to their employers can only – save in some blackboard theory-world – harm the very employees who allegedly stand to benefit most from such restrictions on their bargaining powers.
