The rule of law requires something more than rule by statutes rather than fiat; it requires that the statutes themselves should be rational and general, not arbitrary, capricious, whimsical, or discriminatory. To this general proposition American courts have always assented, although in the field of economic regulation they seem to have forgotten it.
