Principles, unlike prescriptive rules, don’t aspire to literal certainty. What principles offer instead is coherence – principles such as “unreasonable searches and seizures” or a “homelike environment” are readily internalized. As Judge Richard Posner observed, “standards that capture lay intuitions about right behavior may produce greater legal certainty than a network of precise but technical non-intuitive rules.”
